Full End User License Agreement

1. About this agreement

This End User License Agreement ("Agreement") applies to Divine Punishment plugins, any standalone application supplied with a product, and their accompanying documentation (together, the "Software").

Read this Agreement before installing or using the Software. By installing, copying or using the Software, you accept these terms. If you do not agree, do not install or use the Software. Nothing in this Agreement removes rights that applicable law does not permit you to waive.

2. License grant

Divine Punishment grants you a non-exclusive, limited license to install and use the Software on your computer or computers for personal and commercial use, subject to this Agreement.

The license is non-transferable except with prior written consent from Divine Punishment. You receive permission to use the Software, not ownership of it.

You may use the Software in personal and commercial audio projects. This Agreement does not transfer ownership of your original recordings or compositions to Divine Punishment.

3. Restrictions

Except where applicable law permits otherwise, you may not:

• Reverse engineer, decompile or disassemble the Software, or otherwise attempt to discover its source code, algorithms or underlying structure.
• Modify, adapt or translate the Software, or create derivative versions of the Software.
• Distribute, sublicense, sell, lease, rent, loan or otherwise transfer the Software to another party without prior written consent from Divine Punishment.
• Remove, alter or obscure proprietary notices, labels or marks.
• Use the Software for an unlawful purpose.

These restrictions concern the Software itself. They do not prohibit making personal or commercial audio with it.

4. Intellectual property

The Software and its intellectual property remain the property of Divine Punishment and, where applicable, its licensors. They are protected by copyright and other intellectual-property laws.

This Agreement grants no ownership rights to the Software. Any third-party notices or licenses included with a product continue to apply to the materials they cover.

5. Installation and activation

Install the version supplied for the product and platform you acquired, and follow its installation instructions. If a product requires activation, use the license key supplied for that product.

This Agreement does not promise the availability of every operating system, plugin format or future version. Refer to the offer and the requirements supplied with your purchase.

6. Warranty disclaimer

TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NONINFRINGEMENT. DIVINE PUNISHMENT DOES NOT GUARANTEE THAT THE SOFTWARE WILL OPERATE WITHOUT ERRORS OR INTERRUPTIONS.

This disclaimer does not exclude mandatory warranties, consumer rights or remedies that cannot lawfully be excluded.

7. Limitation of liability

To the extent permitted by applicable law, Divine Punishment is not liable for indirect, incidental, special or consequential losses arising from use of, or inability to use, the Software, including loss of profits or data.

Nothing in this Agreement excludes or limits liability for fraud, willful misconduct, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited.

8. Termination

If you fail to comply with this Agreement, Divine Punishment may terminate your license, subject to applicable law. When the license ends, you must stop using the Software and delete the copies in your possession or control.

This requirement concerns copies of the Software. It does not require you to delete your original recordings or compositions.

9. Applicable rights

This Agreement is subject to applicable law. If a term conflicts with a mandatory legal right, that right prevails to the extent of the conflict.

The license for an existing purchase is not automatically replaced merely because a newer version of this page appears.

10. Agreement and questions

This Agreement and the product and platform entitlements stated in your purchase describe your license to use the Software. They do not override rights, representations or remedies that applicable law makes binding.
